Terms of Service

Comprehensive usage rules for the CertifEye platform. By using our site, you agree to these legal definitions and limitations.

1. Introduction & Acceptance

Welcome to CertifEye ("The Platform"), a SaaS solution designed for the probabilistic analysis of digital media (images and videos).

By creating an account, accessing, or using the Service (even as a guest), you explicitly acknowledge and accept these Terms of Service ("ToS") without reservation. If you do not agree, you must cease using the Platform immediately.

2. Definitions

  • "Service": The CertifEye website, API, and analysis engines.
  • "User": Any individual or entity accessing the Service.
  • "Credits": The internal unit of value used to pay for Premium services.
  • "Media": Digital files (images, videos) uploaded for analysis.
  • "Analysis Interface": The on-screen analysis page displaying probability scores, indicators, heatmaps, metadata, and contextual signals related to a Media file.
  • "Report": A downloadable or accessible digital document (PDF or Web format), generated upon request, summarizing the analysis results, indicators, and conclusions for a specific Media file.
  • "Certificate": A digitally issued document confirming that a specific Media file has been analyzed through the CertifEye system at a given date and time.
  • "Authentic" / "Fake": In the context of this Service, these terms refer to statistical probabilities of modification, not absolute factual truth.

3. Description of the Service

CertifEye provides tools to detect potential traces of AI generation or digital manipulation. The Service delivers a probabilistic opinion based on algorithms available at the time of analysis.

The Service includes automated detection (Standard/Premium) and optional Human Review. The results are indicative and informative. The Service provides access to analytical outputs generated by CertifEye’s proprietary systems. The User purchases a right to access and use these outputs, not ownership of the underlying technology or analytical methods.

4. NATURE OF RESULTS & NO LEGAL GUARANTEE

PROBABILISTIC ESTIMATION: All scores (e.g., "Reality Score") are statistical estimates based on current technology. They are NOT statements of absolute fact. CertifEye does not certify factual truth, authenticity, or legality of content, but provides a technical assessment based on available signals at the time of analysis.

NOT LEGAL PROOF: CertifEye reports DO NOT constitute forensic evidence, legal proof, or judicial expertise.

PROHIBITED USE: You are strictly prohibited from using CertifEye results as the sole basis for legal action, employee termination, or financial decisions.

5. Free vs. Paid Services

  • Free Analysis: Provides a limited overview. We reserve the right to restrict, suspend, or modify free access at any time without notice.
  • Premium Analysis: Premium Analysis provides access to advanced detection engines and features for the duration of the processing of the submitted Media.
  • Continuity: There is no guarantee of indefinite service continuity for free tiers.

6. Credits & Payments

Credits are non-transferable and non-refundable (except as required by law, see Terms of Sale). CertifEye reserves the right to adjust pricing at any time. Any applicable taxes are the responsibility of the User.

7. Human Review Disclaimer

When a "Human Review" is requested, an expert provides a professional opinion based on visual inspection and tool data. This opinion:

  • Is NOT a scientific absolute nor a legal warranty.
  • Does NOT transfer liability to CertifEye for the authenticity of the content.
  • Is limited to the specific file provided.

Human Review does not replace forensic analysis, expert testimony, or judicial assessment.

8. User Responsibilities

You warrant that you own the rights to the Media you upload or have explicit permission to analyze it. You agree NOT to upload:

  • Illegal content (CSAM, terrorism, prohibited material).
  • Content that defames or harasses others.
  • Malicious software or data designed to impair the Service.
  • Files containing adversarial perturbations, exploits, or data designed to manipulate, reverse-engineer, or crash the detection algorithms.

The User is solely responsible for how analysis results are interpreted, communicated, or used.

9. Intellectual Property

CertifEye Ownership:

CertifEye retains full and exclusive ownership of the Platform, its software, algorithms, analysis engines, methodologies, interfaces, and all outputs generated by the Service, including but not limited to Analysis Interfaces, Reports, Certificates, scores, heatmaps, indicators, and analytical conclusions, regardless of whether such outputs are accessed through free or paid services.

User License:

Upon valid purchase of Credits and execution of an analysis, the User is granted a personal, non-exclusive, non-transferable, and non-sublicensable right to access, view, download, and use the generated Reports or Certificates for personal or professional purposes.

This license does not constitute a transfer of ownership and does not authorize resale, sublicensing, automated extraction, or commercial exploitation of CertifEye outputs, systems, or methodologies.

10. Data & Privacy

CertifEye processes personal data and uploaded Media in accordance with its Privacy Policy, which forms an integral part of these Terms of Service.

Uploaded Media (images and videos) may be temporarily stored, processed, and analyzed within CertifEye’s secured infrastructure for the sole purposes of delivering the Service, ensuring its integrity, and continuously improving detection accuracy.

10.1 Pseudonymization & Traceability

Media uploaded to the Service is internally assigned a unique technical identifier (Image ID).
While Media is not publicly associated with a user’s identity, CertifEye systems technically allow authorized administrators to trace an Image ID back to the originating account when strictly necessary.

This traceability may occur exclusively for the following legitimate purposes:

  • Security and fraud prevention
  • System integrity and abuse detection
  • Quality control and accuracy validation
  • Legal or regulatory compliance
  • Internal audits and incident investigations

Such access is strictly limited to authorized personnel, logged, monitored, and governed by internal access control policies.

Data used for system improvement may be pseudonymized. Pseudonymization does not prevent internal re-identification when legally or operationally required.

10.2 AI Training & System Improvement

CertifEye is an image authenticity verification service whose core functionality relies on advanced automated detection systems.

By using the Service, the User expressly acknowledges and agrees that:

  • Uploaded Media may be analyzed, labeled, and reused internally to evaluate, calibrate, and improve CertifEye’s detection algorithms.
  • This processing is strictly limited to internal technical purposes related to service quality, robustness, and reliability.
  • Uploaded Media is NEVER used to train generative or creative AI models.
  • Uploaded Media is NEVER sold, licensed, or shared with third parties for commercial or advertising purposes.

Whenever technically feasible, datasets used for system improvement are processed without direct user-facing identifiers.

10.3 Human Review & Administrative Access

Where applicable, uploaded Media may be accessed by Human Experts or authorized operators solely for:
(a) performing a User-requested Human Review, or
(b) validating, labeling, or auditing detection outputs to improve system accuracy.

All Human Experts and administrators are bound by strict confidentiality obligations and operate under controlled access environments.

10.4 Data Retention

Media uploaded for analysis is retained for a maximum period of 15 days to allow for User access, report generation, and dispute resolution.

CertifEye reserves the right to permanently delete Media from its servers at any time before this 15-day period expires, for maintenance or compliance reasons. Once deleted or upon expiration of the 15-day retention window, Media is permanently removed from active systems and cannot be recovered.

10.5 User Rights

Users may exercise their data protection rights as described in the Privacy Policy, including access, rectification, deletion, and data portability, subject to applicable legal and operational constraints.

11. Service Availability

We do not guarantee 100% uptime. The Service may be suspended for maintenance or technical failure. CertifEye is not liable for any loss caused by service unavailability.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

CERTIFEYE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR REPUTATION) ARISING FROM THE USE OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT PAID BY YOU FOR THE SPECIFIC ANALYSIS GIVING RISE TO THE CLAIM. IN NO EVENT SHALL CERTIFEYE BE LIABLE FOR ANY MISUSE OR MISINTERPRETATION OF ANALYSIS RESULTS BY THE USER OR THIRD PARTIES.

13. Indemnification

You agree to indemnify and hold CertifEye harmless from any claims arising out of your violation of these Terms or your use of the analysis results.

14. Account Suspension & Termination

You may terminate your account at any time via your dashboard settings. This action permanently deletes your data, subject to applicable legal retention obligations.

CertifEye also reserves the right to suspend or terminate your account without notice if we suspect a violation of these Terms, abusive behavior, or illegal usage.

IN CASE OF TERMINATION FOR VIOLATION OF THESE TERMS, YOU WILL NOT BE ENTITLED TO ANY REFUND OF UNUSED CREDITS OR SUBSCRIPTIONS.

15. Modifications

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.

16. Governing Law & Language

These Terms are governed EXCLUSIVELY by the laws of the Principality of Monaco.

Any dispute arising from the validity, interpretation, or performance of these Terms shall be submitted to the exclusive jurisdiction of the courts of the Principality of Monaco. The official language for any dispute resolution, mediation, or legal proceeding shall be French.
